The FXComps License

IMPORTANT - READ CAREFULLY: The FXComps License, which is an End User Licence Agreement, is a legal agreement between YOU as Licensee and Codeiron Ltd. for the SOFTWARE PRODUCT identified hereinafter. By installing, copying, or otherwise using the SOFTWARE PRODUCT, YOU agree to be bound by the terms of this license. If YOU do not agree to the terms of this license, return the SOFTWARE PRODUCT to the place of purchase for a full refund, or do not download the SOFTWARE PRODUCT.

The copyright in the SOFTWARE PRODUCT and its documentation is owned by Codeiron Ltd., Hungary. Subject to the terms of this License, YOU are granted a non-exclusive, non-transferable right to use the SOFTWARE PRODUCT. YOU do not acquire ownership of copyright or other intellectual property rights in any part of the SOFTWARE PRODUCT by virtue of this license. Your use of this software indicates your acceptance of the FXComps License and warranty.

1. DEFINITIONS

In the FXComps license, unless the contrary intention appears:

LICENSE means this FXComps License which is an end user licence agreement.

CODEIRON means Codeiron Ltd., Hungary. (For more information visit: www.codeiron.com)

LICENSEE or YOU means you, or the organisation (if any) on whose behalf you are taking the License.

SOFTWARE PRODUCT or SOFTWARE means an FXComps component or a class library, which is distributed as a compiled SWC library, and online or electronic documentation.

SUPPORT SERVICES means email based support provided by Codeiron, including advice on usage of an FXComps component or a library for a period of thirty (30) days, investigation of bugs and fixes for a period of ninety (90) days.

2. GRANT OF LICENSE

CODEIRON grants you the following rights provided that you comply with all terms and conditions of this License:

2.1. To install and use the SOFTWARE PRODUCT. Purchasing an end user license of a SOFTWARE PRODUCT YOU can use that SOFTWARE PRODUCT in unlimited number of projects.

2.2. To make copies of the SOFTWARE PRODUCT for backup and archival purposes.

3. LIMITATIONS

EXCEPT AS EXPRESSLY AUTHORIZED ABOVE, YOU SHALL NOT: COPY, IN WHOLE OR IN PART, SOFTWARE OR DOCUMENTATION; MODIFY THE SOFTWARE; REVERSE ENGINEER, DECOMPILE, OR DISASSEMBLE ALL OR ANY PORTION OF THE SOFTWARE; OR RENT, LEASE, DISTRIBUTE, SELL, OR CREATE DERIVATIVE WORKS OF THE SOFTWARE.

4. RESERVATION OF RIGHTS AND OWNERSHIP

CODEIRON reserves all rights not expressly granted to you in this LICENSE. The SOFTWARE is protected by copyright and other intellectual property laws and treaties. CODEIRON owns the intellectual property rights in the SOFTWARE. The SOFTWARE is licensed, not sold.

5. LIMITED WARRANTY

After purchasing an end user license of the SOFTWARE PRODUCT YOU are entitled to SUPPORT SERVICES provided by CODEIRON for the previously defined period from the date of purchase outside of Hungary. In Hungary YOU are entitled to SUPPORT SERVICES provided by CODEIRON for a period of one year. Except for the foregoing, this SOFTWARE IS PROVIDED "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL CODEIRON OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

6. TERMINATION

Without prejudice to any other rights, CODEIRON may terminate this LICENSE if YOU fail to comply with the terms and conditions. Upon termination YOU or YOUR representative shall destroy all copies of the SOFTWARE PRODUCT and all of its component parts or otherwise return or dispose of such material in the manner directed by CODEIRON.

7. TRADEMARKS

All names of products and companies used in this License, the SOFTWARE PRODUCT, or the enclosed documentation may be trademarks of their corresponding owners. Their use in this License is intended to be in compliance with the respective guidelines and licenses.

Adobe, the Adobe logo, Flex, Flex Builder and Flash Player are either registered trademarks or trademarks of Adobe Systems Incorporated. ActiveX and Windows are either registered trademarks or trademarks of Microsoft Corporation. All other trademarks are the property of their respective owners.
